Terms of Use

This End User Licence Agreement ("Terms") governs your use of the mobile application Neon Phoenix, published by TRISIMIO SL on the Apple App Store. By downloading or using the app you accept these Terms in full.

1. Licence Grant

TRISIMIO SL grants you a personal, non-exclusive, non-transferable, revocable licence to install and use Neon Phoenix on Apple devices you own or control, subject to the Usage Rules set out in the Apple Media Services Terms and Conditions.

This licence does not permit you to:

• Distribute, sell, sublicence or transfer the app to any third party
• Decompile, reverse-engineer or disassemble the app
• Modify, create derivative works or remove intellectual property notices
• Use the app for commercial purposes without written authorisation
• Circumvent any technical protection measures

2. Purchase and Pricing

Optional add-on content (biome DLC, cosmetic packs, Supporter Pack) is available as separate, non-mandatory purchases at launch or on future dates.

All prices include applicable VAT for your territory. Apple acts as the sales agent and handles payment processing.

3. Refunds

Refunds are handled exclusively by Apple under their refund policy. TRISIMIO SL does not process refunds directly. To request a refund visit reportaproblem.apple.com.

4. Intellectual Property

TRISIMIO SL is the exclusive owner of all intellectual property rights in Neon Phoenix, including but not limited to: source code, procedural graphics, synthesised music, level design, character names, logos and all other creative elements.

The name "Neon Phoenix" and associated logo are trademarks of TRISIMIO SL. "Trimonkey" is the publishing trade name of TRISIMIO SL.

Nothing in these Terms transfers any intellectual property rights in the app or its content to you.

5. User-Generated Content

Neon Phoenix has no user-generated content features (no in-app chat, uploads or communities). Scores published to Game Center are governed by Apple's terms.

6. Updates and Service Continuity

TRISIMIO SL may publish updates with improvements, fixes or new content. Maintenance updates are free. Substantial new content may be offered as optional paid DLC.

TRISIMIO SL reserves the right to discontinue the app with reasonable notice. Given the offline-first model, the game will continue to function on your device indefinitely without connecting to proprietary servers.

7. Limitation of Liability

To the maximum extent permitted by applicable law, TRISIMIO SL shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the app.

TRISIMIO SL's total liability to you for any claim relating to the app shall not exceed the price you paid for it.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential damages, so the above limitations may not apply to you.

8. Disclaimer of Warranties

The app is provided "as is" and "as available". TRISIMIO SL does not warrant that the app will be uninterrupted, error-free, or meet all your specific requirements. This does not affect any rights you may have as a consumer under applicable law.

9. Legal Compliance

You agree to use the app only in accordance with applicable laws in your territory. Use of the app for illegal activities is expressly prohibited.

10. Minors

If you are under 18 years old, you need the consent of a parent or legal guardian to download and use the app, in accordance with Apple App Store policies and applicable law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. For any dispute arising from these Terms, the parties submit to the exclusive jurisdiction of the courts of Madrid, Spain, without prejudice to any rights you may have as a consumer under EU consumer protection law.

12. Changes to These Terms

TRISIMIO SL may modify these Terms. Material changes will be notified through an app update or notice on this page. Continued use of the app after notification constitutes acceptance of the updated Terms.
